  • ELEVATE PET HEALTH, LLC SERVICES PLATFORM

    Data Collected through the Elevate Pet Health, LLC Services via uploading of their care plan (“Content”) may include third party personally identifiable information collected and processed under the direction of our Customers, who are the controllers of that data.

    Elevate Pet Health, LLC processes Customer Data, which may contain Personal Data, under the control of our Customer, and Elevate Pet Health, LLC has no direct control or ownership of the Personal Data that we process on behalf of our customers. Customers are fully responsible for complying with any applicable data protection laws or regulations that require notice, disclosure, and/or obtaining consent prior to transferring the Personal Data to Elevate Pet Health, LLC for processing. Terms that are not otherwise defined in this notice shall have the meaning as set forth in the Elevate Pet Health, LLC Terms of Service or Data Processing Agreement addendum, if any. In the event of a conflict between this Privacy Notice and the Customer Terms of Service and/or Customer Data Processing Agreement, the terms of the Customer Terms of Service and Customer Data processing Agreement will control.

    An individual who seeks access to their data, seeks to correct, amend or delete inaccurate data or wishes to opt-out of or remove Personal Data provided by a Elevate Pet Health, LLC Customer should direct his/her query to the Elevate Pet Health, LLC Customer he/she interacts with directly (the data controller). If a third-party requests that we remove personally identifiable information on their behalf, we will attempt to redirect their demand/inquiry to the relevant Elevate Pet Health, LLC Customer.

    Elevate Pet Health, LLC may transfer personal information to other companies that help us provide our Services. Transfers to subsequent third parties are covered by the provisions in this policy regarding notice and choice and the service agreements with our Customers.

    Customers who use elevatepethealth.com will have their Content stored in the United States.

Google Analytics

Google Analytics provides Us with reports with website trends without identifying individual visitors. Site usage is tracked using Google Analytics in accordance with their Privacy Policy. Performive

We use Performive to host our website and the Elevate Pet Health services. Some or all of your data may be stored on Performive systems. Elevate Pet Health, LLC does not sell, rent or lease its customer lists to third parties. Elevate Pet Health, LLC will not otherwise transmit, disclose or share your personal data to non-Elevate Pet Health, LLC persons or businesses for their independent use unless: 1. You specifically authorize it; 2. The information is given to comply with the law, such as a search warrant, court order or subpoena, to enforce an agreement with have with you, or to protect our rights, property or safety, or the rights, property or safety of our employees or others; 3. The information is given to our agents, vendors, affiliates or service providers who perform functions on our behalf; 4. To address emergencies or acts of God; 5. To address disputes, claims, or to persons who are your agents or representatives purporting to have legal authority to act on your behalf. We may also collect aggregated data about our customers and Site visitors and transmit the results of such aggregated (but de-identified) information to our partners, vendors, service providers, advertisers, and third parties for purposes of marketing and promotions.

Processing your Payment

Elevate Pet Health, LLC does not store your payment information. Customer subscription information is recorded in our application and passed to a third-party processor, Sripe, only to verify the account for customer support purposes.

Access to Stripe is limited to key Elevate Pet Health, LLC personnel; such access is personally identifiable to specific individuals and password protected to maintain control over access and preserve accountability for misuse.

Law Enforcement and Internal Operations

Personal Data may be provided where we are required to do so by law, or if we believe in good faith that it is reasonably necessary

  • to respond to claims asserted against Elevate Pet Health, LLC or to comply with the legal process (for example, discovery requests, subpoenas or warrants);
  • to enforce or administer our policies and agreements with users;
  • for fraud prevention, risk assessment, investigation, customer support, product development and de-bugging purposes;
  • or to protect the rights, property or safety of Elevate Pet Health, LLC’s users or members of the general public.

We will use commercially reasonable efforts to notify users about law enforcement or court ordered requests for data unless otherwise prohibited by law. We engage Service Providers or “Data Processors” to perform services on our behalf to help us provide services to you. Additionally, we engage third-party Data Processors to assist us in processing of credit cards, marketing, IT infrastructure, cloud computing, SaaS, data enhancement and other services to enhance your experience with our subscription services as well as our website and business in general.

These third-party Data Processors may have access to your personal data in order to provide such functions.

We require all Data Processors to agree to take reasonable steps to keep Personal Data that we provide to them secure. We never authorize them to use or disclose your Personal Data except in connection with providing their services.

In addition, Elevate Pet Health, LLC may share data with trusted partners as data processors to help us perform statistical analysis, send you email or postal mail, provide customer support, or to deliver our services to you. All such third parties are prohibited from using your personal information except to perform data processing according to Elevate Pet Health, LLC’s instructions in order to provide our services to you, our customer.

How is my data protected?

Elevate Pet Health, LLC secures your personal information from unauthorized access, use or disclosure. Data Storage and Retention

Your personal data is stored on Elevate Pet Health, LLC’s servers as well as the servers of Elevate Pet Health, LLC’s cloud and SaaS based systems, located in the United States. Elevate Pet Health, LLC keeps your data for as long as you are a Elevate Pet Health, LLC subscriber. Right to Review or Change Your Data

If your personal information changes, you may correct, update, amend, possibly remove, or ask to have it removed by contacting the veterinary clinic by phone or email at the contact information available on our web site.

We will retain your information for as long as your account is active, as needed to provide you the Services and as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Right to Withdraw Consent

You have the right to withdraw consent where such consent is required to share or use data and you may request that we delete your Personal Data. However, if you are requesting that we delete your Personal Data that we have collected as part of your established and active Wellness Plan, you will have to cancel your subscription prior to requesting that your Personal Data be deleted.

If you receive communications from us and no longer wish to receive them, please follow the removal instructions in the email or change your account settings.

Right to Remove

Regarding data we have collected by means other than the purchase of a Wellness Plan, you can email our Data Officer and request the deletion of your Personal Data.

If you have an active Wellness Plan and you want your Personal Data to be removed, please contact our Data Officer at the below email address and request that your Wellness Plan be cancelled first and then your Personal Data can be removed.

If you have had a Wellness Plan in the past but you are no longer an active subscriber and you want your Personal Data to be removed, please email our Data Officer.

Supplemental Privacy Notice For California Residents

This Supplemental Privacy Notice supplements the information in our Privacy Policy, and applies solely to California residents. It applies to Personal Data we collect as a business; it does not apply to Personal Data we collect or otherwise process as a service provider.

Elevate Pet Health, LLC as a “Business” and a “Service Provider”

We will also be a business as to the Personal Data that we have obtained about the use of the Elevate Pet Health subscription service, which could relate to Consumers. We use this to conduct research and analysis to help better understand and serve Users of the Services as well as to improve our platform.

However, if you use Elevate Pet Health, LLC’s subscription service (for example, managing a contract between you and a third party) as a Consumer, we will process your Personal Data to help manage that contract on your behalf. In these circumstances, Elevate Pet Health, LLC merely provides the tools for Customers; Elevate Pet Health, LLC does not decide what Personal Data to upload to the Customer’s subscription account, nor is it responsible for the continued accuracy any Personal Data provided. Any questions that you may have relating to your Personal Data and your rights under California law should therefore be directed to the Customer as the business, not to Elevate Pet Health, LLC.

You will be required to verify your identify before we fulfill your request. To do so, you will need to provide us with certain account information, such as the full name and email address you used to create your account and your account user id. You can also designate an authorized agent to make a request on your behalf. To do so, you must provide us with written authorization for the agent to act on your behalf. You will still need to verify your identity directly with us.

The CCPA sets forth certain obligations for businesses that “sell” Personal Data. Based on the definition of “sell” under the CCPA and under current regulatory guidance, we do not believe we engage in such activity. We do share certain information as set forth in this Privacy Notice and allow third parties to collect certain information about your activity, for example through cookies, except as explained in our Detailed information on our collection of Cookies section of our Privacy Notice.
